Section 106 Programmatic Agreement (PA)

The Georgia DOT must comply with Section 106 of the National Historic Preservation Act (NHPA) of 1966 for federal funding and permitting. Section 106 requires agencies to consider the effects of their actions upon historic resources listed in or eligible for listing in the National Register of Historic Places when planning projects. In the decades since the NHPA was passed, the Federal Highway Administration (FHWA), Georgia Division and the Georgia State Historic Preservation Officer (GA SHPO) have developed policies and procedures with GDOT to facilitate the Section 106 review of transportation projects in Georgia. These policies and procedures have been documented in a variety of agreement documents over the years. The current PA consolidates those agreements and includes the USACE as a signatory along with the GA SHPO, ACHP, and federally recognized tribes.

Updated Section 106 PA and Cultural Resources Manual: Public Notice

GDOT is currently inviting public comment on an updated draft Programmatic Agreement (PA) for compliance with Section 106 of the National Historic Preservation Act. The draft agreement helps streamline the process for considering potential impacts to historic structures, archaeological sites, and other cultural resources during transportation projects involving federal funds or permits. The updated PA builds upon the original 2019 agreement and was developed in consultation with the Federal Highway Administration (FHWA); US Army Corps of Engineers, Savannah District; State Historic Preservation Officer (SHPO); Advisory Council on Historic Preservation (ACHP) and federally-recognized tribal governments including the Muscogee (Creek) Nation, Alabama-Quassarte Tribal Town, Absentee Shawnee Tribe of Oklahoma, and the Catawba Indian Nation as invited signatories. In addition to the PA, an updated Cultural Resource Manual accompanying the Agreement is available for review and comment. The manual outlines procedures used by GDOT in fulfillment of the Agreement.
